Terms and conditions for SAPFS membership and services

1. Acceptance of Terms

By accessing and using the South African Punters Forum Syndicate ("SAPFS") website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Syndicate Membership

2.1 Eligibility

  • Members must be at least 18 years of age
  • Members must comply with all NHRA (National Horseracing Authority) regulations
  • Members must provide accurate and complete information during registration

2.2 Membership Rights

As a SAPFS member, you are entitled to:

  • Ownership stake in syndicate horses proportionate to your investment
  • Share in prize money distributions according to ownership percentage
  • Access to member-exclusive content and updates
  • Participation in syndicate decisions and governance matters
  • Attendance at race days and stable visits

3. Financial Terms

3.1 Contributions and Fees

  • Initial membership fees and horse acquisition costs as specified in membership agreements
  • Ongoing training fees, veterinary costs, and race entry fees shared proportionally
  • Administrative fees for syndicate management and operations
  • All fees are non-refundable unless otherwise stated in writing

3.2 Prize Money Distribution

Prize money will be distributed to members according to their ownership percentage, after deduction of:

  • Trainer's percentage (as per NHRA regulations)
  • Jockey's percentage (as per NHRA regulations)
  • Outstanding training and veterinary costs
  • Syndicate administrative fees

4. Horse Ownership and Management

4.1 Ownership Structure

All horses are owned collectively by syndicate members, with Deva Govender acting as the official nominee and representative registered with the NHRA.

4.2 Horse Management Decisions

Management decisions include but are not limited to:

  • Trainer and jockey selection
  • Race entry and campaign planning
  • Veterinary care and treatment
  • Sale, retirement, or breeding decisions

The syndicate nominee, in consultation with trainers and members, makes day-to-day operational decisions in the best interest of the horses and syndicate.

5. Member Obligations

  • Pay all required fees and contributions on time
  • Comply with NHRA rules and racing regulations
  • Maintain confidentiality of member-only information
  • Conduct themselves professionally at race days and syndicate events
  • Notify the syndicate of any changes to contact information
  • Respect decisions made by the syndicate management and nominee

6. Website Use and Content

6.1 Intellectual Property

All content on this website, including text, graphics, logos, images, and videos, is the property of SAPFS or its content suppliers and is protected by copyright and intellectual property laws.

6.2 Acceptable Use

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any systems or data
  • Transmit viruses, malware, or harmful code
  • Copy, reproduce, or distribute content without permission
  • Harass, defame, or harm other members or users

7. Liability and Risk Disclosure

7.1 Investment Risk

Horse racing is an inherently risky investment. Members acknowledge that:

  • There is no guarantee of prize money or return on investment
  • Horses may suffer injury, illness, or poor performance
  • Ongoing costs may exceed prize money earned
  • Members may lose some or all of their investment

7.2 Limitation of Liability

SAPFS, its officers, and representatives shall not be liable for any indirect, incidental, special, or consequential damages arising from syndicate membership or website use. Our liability is limited to the amount of fees paid by the member.

8. Termination

8.1 Voluntary Withdrawal

Members may withdraw from the syndicate subject to:

  • Written notice to the syndicate nominee
  • Settlement of all outstanding fees and obligations
  • Terms specified in the membership agreement

8.2 Termination by SAPFS

We reserve the right to terminate membership for breach of these terms, non-payment of fees, or conduct detrimental to the syndicate.

9. Dispute Resolution

Any disputes arising from these terms or syndicate membership shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be subject to arbitration or mediation under South African law.

10. Regulatory Compliance

SAPFS operates under the regulations and authority of the National Horseracing Authority of Southern Africa (NHRA). All members must comply with NHRA rules and regulations.

11. Amendments

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page. Continued use of our services constitutes acceptance of modified terms.

12. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any legal action must be brought in the appropriate South African courts.
